Acceptance of the terms

This cards2order.com web site ("Site") is a service of The Almanac Gallery (Almanac). Almanac provides its services to you subject to the following Terms and Conditions of Use ("Terms") which we may amend from time to time. By accessing or using this Site you are agreeing to comply with and are bound by the Terms. If you are not agreeable to the terms please do not use this site.

"Products" means charity Christmas cards, the Christmas cards available for overprinting, the everyday one to one cards and any other product or service displayed on the web site which we agree in our email acceptance of order to supply to you.

It is your responsibipty to read these Terms carefully and raise any problems before you place an order.

It is your responsibipty to check that your order is accurate and to give us all the information we ask for in order to be able to complete your order.

Use of this site

You agree to access this site solely for the purposes for which it is intended and not to use the site for any illegal purpose or in a damaging, objectionable or harmful manner or in any way which interferes with the administration of this site.

You agree that you will not make any misrepresentation as to your identity or authority.

Unauthorised use of all or any part of the content of this site or access to its back-up administration is unauthorised and may be the subject of criminal or civil proceedings.

In using this site outside the UK you are entirely responsible for comppance with local laws or jurisdictions elsewhere and will keep Almanac fully indemnified against all actions, damages and compensation paid by Almanac as a result of any breach or of these terms and conditions.

Our Guarantee

We guarantee that your cards will be perfectly printed and delivered on time. If the situation arises where merchandise is faulty or not produced to your specification, we will replace them immediately if you notify us in writing within 7 days of accepting delivery. In order for us to do this quickly and efficiently we need you to check your delivery on receipt.

Price of the Products

Pricing for products, services and any delivery costs will be in pounds sterling, when you complete your order sheet and will also be indicated in a total summary even though you may be offered an option to make credit card payments billed in other currencies.

Prices indicated at checkout will include VAT at the rate prevailing, if the delivery address for the product is within the European Union. Delivery addresses outside the European Union will not be charged VAT, any local taxes and customs charges that may be applicable will be your responsibility.

Almanac reserve the right to revise the (ex VAT) price of products at any time prior to acceptance of order.

Payment

Orders will only be fulfilled against receipt of cleared payments.

Subscriptions

Payment for One-to-one card sales can be debited against a subscriber's initial subscription, which will be extinguished after one year (after e-mail notice) if it has not been replenished. Where the account has been replenished in any year it may continue for the following year until such time as it has been extinguished or for a further year if the subscription has been fully renewed.

You are entitled to a full refund of any subscription balance in the event that the service ceases.

Delivery

Bulk orders for personalised cards will only be despatched once payment has been received. Delivery will be to the postal address stipulated on your order sheet and delivered to a UK mainland address within 14-21 working days. Outside UK mainland delivery schedules will be advised on confirmation of order.

Personalised One-to-One cards will only be despatched within the next working day, or same day for orders received by 2pm on any working day provided that payment has been authorised or debited against the outstanding balance in a subscriber's account payment. Delivery will be to the postal address stipulated on your envelope personalisation by first class mail within the UK and by Airmail elsewhere.

The current terms of delivery for other goods or services are either indicated at point of sale or should be arranged with Almanac's customer service team.

Ownership of the Products

The Products shall remain Almanac property and ownership shall not pass to you until their full price has been paid to us.

Cancellation and amendments to orders

With regard to personalised products, amendments to orders or cancellations can not be accepted once the order has been placed. If an order for personalised products is cancelled or amended you will be liable to pay in full for any part of your order that has been personalised prior to your cancellation or amendment, as well as any reasonable administrative or delivery costs incurred by us as a result of your cancellation or amendment.

Disclaimer

Almanac provide this web site on an "as found" basis without warranties express or implied as to fitness for purpose, as to functionality, or the availability of uninterrupted or error free operation.

Limits of liability

Neither Almanac nor its suppliers accept liability for any consequential loss or damage incurred through use of, or inability to use, this site and in any case Almanac's liability shall not extend beyond the amount paid by you for the relevant goods or services or alternatively beyond the provision of alternative goods or services as agreed in writing.

Site users agree to hold Almanac harmless and to reimburse all legal costs consequential upon any illegal or damaging behaviour in connection with this web site.

cards2order.com is a service provided by The Almanac Gallery whose office is at 130 New Kings Road, London SW6 4GG England.

The cards2order.com web site contains material that is subject to intellectual or proprietary rights of The Almanac Gallery and other third parties. By accessing this Site you acknowledge and agree that these rights belong to their respective owners and they are protected in all forms either as they now exist or as they may be developed in the future.

Where there is a reference to "working days" in this agreement this shall mean Monday to Friday inclusive but excluding any statutory or bank holiday in England.

These Terms and the agreement between us are subject exclusively to English law and the jurisdiction of the English Courts

These Terms & Conditions do not affect your statutory rights as a consumer and where any part of this contract shall not be for any reason enforceable it is agreed that this will not invalidate the enforceability of other provisions.

Almanac reserve the right to amend or add to these Terms & Conditions from time to time with appropriate notification being placed on line.
